James Ficenec

James J. Ficenec represents businesses of all sizes, from international corporations to start-up companies, as well as individuals, in sales, acquisitions, leasing, operations and employment issues. He also represents his business clients both at trial and at the appellate level, in business, real estate, products liability and employment litigation.

Through over 20 years of practice, Jim has had success litigating cases in both federal and state courts. He is especially well known and respected in the business litigation arena through his representation of national and international corporations and material suppliers. Jim is also an experienced appellate lawyer and has argued civil appeals before the California District Courts of Appeal and the Ninth Circuit Court of Appeals. He was appellate counsel in Carrau v. Marvin Lumber & Cedar Co. (2001) 93 Cal.App.4th 281, in which the Appellate Court limited California’s strict product liability laws and acknowledged that plaintiffs suing under tort theories are not entitled to recover the cost of repairing or replacing a defective product. Jim was also appellate counsel in Washoe Development Company v. Guaranty Federal Bank (1996) 47 Cal.App.4th 1518, in which the Appellate Court discussed the application of anti-deficiency laws to the enforcement of out-of-state judgments.

Jim is a member of the American Bar Association, the State Bar of California and the Hawaii State Bar Association. He was admitted to practice in Hawaii in 1989 and in California in 1991. He is an adjunct professor at the John F. Kennedy University School of Law and serves on the Board of Directors of New Connections, a non-profit organization that specializes in community behavioral healthcare.
